File Online Frequently Asked Questions

The Dust Diseases Tribunal offers digital services to file, access, and manage documents online from anywhere at any time

Who can file online?

Any party that is currently able to file a form in the Dust Diseases Tribunal can file these forms online provided they have registered an account with the Online Registry.

This includes:

  • Legal representatives (including delegates)
  • Self-represented litigants
  • Authorised Officers
Do I have to register to use online services?

Yes. In order to file online, parties will need to register an account with the NSW Courts and Tribunal Online Registry.

What forms can be filed online?

The following forms can be filed online:

  • DDT Statement of Claim (UCPR Form 3A or 3B)
  • The Plaintiff’s Statement of Particulars (Form 1 in Schedule 2 of the Regulation)
  • Summons (UCPR Form 4A or 4B)
  • Defendant’s Reply (Form 2 in Schedule 2 of the Regulation)
  • Defence (UCPR Form 7A or 7B)
  • Notice of Appearance (UCPR Form 6A or 6B)
  • Reply (UCPR Form 8)
  • Statement of Cross-Claim (UCPR Form 9)
  • Notice of Motion (UCPR Form 20)
  • Subpoena – Evidence (UCPR Form 25)
  • Subpoena – Produce (UCPR Form 26A)
  • Subpoena – Evidence and Produce (UCPR Form 27A)

Can I still file in person at the Tribunal registry?

Yes. MS Word and PDF versions will still be available to download from the Tribunals website and the Uniform Civil Procedure Rules Civil Forms website. These forms can be filed in person at the Tribunal Registry.

Can supporting documents be added to the online forms?

Yes. Up to four supporting documents can be attached online up to a total of 5MB each.

Are there any changes to the way matters at the Tribunal are listed?

No. There are no changes to the current listing processes for the Tribunal.

Are there any changes to the Claims Resolution Process (CRP) Timetable?

No. The CRP still applies to those specific forms filed online for asbestos-related claims. Please refer to the Dust Diseases Tribunal Regulation 2019 for the Asbestos Claims Resolution Process (CRP).

What notification(s) will an applicant receive when they file online?

When users file an application form online, they will receive two auto-generated emails. These are:

  • An acknowledgement that the application has been received. This includes the assigned case file number.
  • A notification acknowledging the application has been processed by the Tribunal Registry. It also includes an attached copy of the sealed and filed stamped form (together with any documents submitted with the application). If the application attracted a fee, a copy of the Online Registry invoice is also attached to this email.
Can filing parties view their cases via the Online Registry?

Yes.  The Online Registry is now available for Tribunal users to manage their cases including viewing filed documents and listings.
